Agreement to Terms

By downloading, installing, or using Trail Hits ("the App"), operated by Trail Hits LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not use the App.

Description of Service

Trail Hits is a bike management application that helps users track maintenance, monitor component wear, and optimize their setup using ride data. The App supports traditional and electric bikes and is available on the Web, iOS, and Android.

Account Registration

To use Trail Hits, you must:

• Be at least 13 years old
• Provide accurate registration information
• Keep your account secure and not share access with others
• Accept responsibility for all activity under your account

Free Trial and Subscription

Trail Hits offers a free trial with limited usage. After the trial period:

• A paid subscription is required for continued access
• Payment is processed through the App Store (iOS), Google Play (Android), or Stripe (Web)
• Subscriptions renew annually unless cancelled before the renewal date
• If you subscribed through the App Store or Google Play, your subscription is managed and billed by that platform. Cancellation must be done through that platform's subscription settings
• If you subscribed through the Web, you can manage your subscription through your Trail Hits account settings
• Promotional offers may be available from time to time and are subject to their specific terms

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer or decompile the App
• Allow others to access your account

Intellectual Property

The Trail Hits™ name, logo, icons, and visual brand identity are the exclusive property of Trail Hits LLC. All content, features, functionality, software, source code, designs, and documentation associated with the App are owned by Trail Hits LLC and are protected by United States and international copyright, trademark, trade secret, patent, and other intellectual property laws.

Trail Hits' proprietary technology includes, without limitation, our component wear and strain calculation algorithms, suspension tuning and problem-solving systems, service interval prediction models, and ride data analysis methods. These constitute trade secrets and confidential information of Trail Hits LLC.

You may not:

• Copy, modify, distribute, sell, or create derivative works based on the App or any of its content
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the App
• Use the Trail Hits name, logo, or brand assets without prior written permission
• Scrape, crawl, or use automated means to extract data or content from the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use any of Trail Hits' proprietary technology, algorithms, or methods to develop a competing product or service

All rights not expressly granted in these Terms are reserved by Trail Hits LLC.

Your Content

You retain ownership of the data you input into the App (bike information, component details, maintenance records, ride data, etc.). By using the App, you grant Trail Hits a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your data as necessary to provide and improve the service.

You also grant Trail Hits the right to use your data in aggregated, anonymized, and de-identified form for product improvement, analytics, and research purposes. Aggregated data will never identify you personally.

You are solely responsible for the accuracy and legality of the content you submit. You represent that you have the right to share any data you input and that your content does not infringe on the intellectual property rights of any third party.

Third-Party Services

Trail Hits integrates with third-party services like Strava. Your use of these integrations is subject to those services' terms and privacy policies. We are not responsible for third-party services.

SMS Messaging

For Bike Shops

If you use Trail Hits as a bike shop to send SMS messages to customers, you agree to:

• Obtain verbal consent from the customer before entering their phone number into the platform
• Only enter phone numbers for customers who have agreed to receive service-related text messages
• Use SMS messaging solely for transactional service communications (estimates, status updates, pickup notifications)
• Not use the platform to send marketing, promotional, or bulk messages

For Customers Receiving Messages

If you receive text messages from Trail Hits on behalf of a bike shop:

• You may opt out at any time by replying STOP to any message
• After opting out, you will receive a confirmation and no further messages will be sent
• Message frequency varies based on your service activity, typically 1–3 messages per service visit
• Message and data rates may apply — contact your mobile carrier for details

Phone Number Privacy

Trail Hits does not sell, rent, or share phone numbers with third parties for marketing purposes. Phone numbers are used exclusively for service-related communications between shops and their customers through the Trail Hits platform. For more details, see our Privacy Policy.

Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that:

• The App will be error-free or uninterrupted
• Strain calculations will be perfectly accurate
• Service reminders will prevent all component failures

Important: Trail Hits provides maintenance suggestions based on estimated wear. Always inspect your bike regularly and consult a qualified mechanic for safety-critical components. We are not liable for any damage or injury resulting from component failure.

Limitation of Liability

To the maximum extent permitted by law, Trail Hits LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App. Our total aggregate liability for all claims arising from or related to the App shall not exceed the amount you paid to Trail Hits in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Trail Hits LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit through the App that infringes on the rights of others.

Termination

We may terminate or suspend your account at any time for violation of these terms. You may delete your account at any time through the App settings.

Upon termination, your right to use the App ceases immediately. Data associated with your account will be deleted in accordance with our Privacy Policy.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed by the laws of the State of Oregon, United States, without regard to conflict of law provisions.
